    The administrative confirmation on marriage (remarriage) registration by Shanghai residents with foreigners, overseas Chinese and residents from Hong Kong, Macau or Taiwan

    2. Legal basis

    The ¡°Marriage Law of the People's Republic of China¡± (April 28, 2001)

    The ¡°Marriage Registration Regulations¡± (August 8, 2003)

    3. Conditions for acceptance

    1). Both parties must reach legal ages for marriage, i.e. 22 years old for men and 20 years old for women;

    2). Both parties must be of their own free will and have no spouse;

    3). Both parties must have neither direct blood relative nor collateral blood relative within three generations with each other;

    4). Both parties must suffer from no illness which is not suitable for marriage;

    5). Either party must be a resident with registered permanent residence in Shanghai;

    6). Both parties must handle the marriage registration together at the Marriage Registration Center of the Shanghai Civil Affairs Bureau obtain the marriage certificate.

    4. Application materials

    For Shanghai resident:

    1). the residence booklet and ID card;

    2). the signed statement of having no spouse, and neither direct blood relative nor collateral blood relative within three generations with the other  (to fill in the statement with uniform format at the Marriage Registration Center).

    For resident from Hong Kong, Macau or Taiwan:

    1). the valid exit-entry permit and ID card;

    2). the statement of having no spouse, and neither direct blood relative nor collateral blood relative within three generations with the other, with the statement notarized by the notary agency of their domicile (valid for six months).

    For overseas Chinese:

    1). the valid passport;

    2). a certificate of having no spouse, and neither direct blood relative nor collateral blood relative within three generations with the other, which is issued by notary agency or other authorities at the resident country and certified by the embassy (consulate) of the People¡¯s Republic of China in the country, or a certificate with the same content issued by the embassy (consulate) of the People¡¯s Republic of China (valid for six months).

    For foreigner:

    1). the valid passport or other identity document

    2). a certificate of having no spouse, which is issued by notary agency or other authorities at the host country and certified by the embassy (consulate) of the People¡¯s Republic of China in the country or the country¡¯s embassy (consulate) in China, or a certificate with the same content issued by the host country¡¯s embassy (consulate) in the People¡¯s Republic of China (valid for six months).

    Notes:

    1). If documents are written in foreign languages, it is necessary to provide the Chinese version translated by qualified units;

    2). Both parties shall submit three recent half-length couple photos (two-inch-sized certificate photos). The size of the photos is 6cm¡Á4cm. It is also applicable for remarriage.

    5. Acceptance department

    The Marriage Registration Center of the Shanghai Civil Affairs Bureau

    6. Procedures

    a) initial check (with ID cards and certificates; documents in foreign languages shall be translated into Chinese);

    b) acceptance (both parties shall fill in the ¡°Declaration for Marriage Registration Application¡±);

    c) examination;

    d) registration (issuing the marriage certificate).

    7. Registration term

    A marriage certificate will be issued on the spot if the certificates and documents are effective and complete upon examination. Marriage registration will be refused if both parties fail to comply with relevant conditions, with a written explanation will be issued.

    8. Charge standard

    The expenses fees of RMB9 per pair for the marriage certificate.
