The Administrative confirmation on divorce registration for couples between Shanghai dwellers and aliens, overseas Chinese or residents from Hong Kong, Macau or Taiwan with marriage registered in China’s mainland

II. Legislative basis

The “Marriage Law of the People's Republic of China” (April 28, 2001)

The “Marriage Registration Regulations” (August 8, 2003)

III. Qualifications for acceptance

1. the two parties concerned shall divorce voluntarily;

2. the two parties concerned shall have reached consensus on issues  including the child raise, property and debt;

3. the marriage registration shall be made in China’s mainland;

4. the two parties concerned shall have full capacity for civil conducts; and

5. the two parties concerned shall co-apply for the divorce registration to the Marriage Registration Center of Shanghai Civil Affairs Bureau and obtain the “Divorce Certificate”.

IV. Application material

Shanghai dwellers:

1. the residence booklet and ID card;

2. the “Marriage Certificate”; and

3. the “Divorce Agreement”.

Residents from Hong Kong, Macau or Taiwan:

1. the valid Mainland Travel Permit and ID card

2. the “Marriage Certificate”; and

3. the “Divorce Agreement”.

Aliens and overseas Chinese:

1. the valid passport or other international travel documents;

2. the “Marriage Certificate”; and

3. the “Divorce Agreement”.

Notes: each party concerned shall submit two recent two-inch, passport-sized, single and hatless photos. (size: 3.5×4.5 cm).

VI. Procedures

Preliminary Examination (with the valid ID cards and marriage certificates of the parties concerned) → Acceptance (filing in the “Declaration for Divorce Registration Application” and the “Divorce Agreement” by the parties concerned) → Review → Registration (issuance of the “Divorce Certificate”).

VII. Time limit

The registration shall be made on the spot and the “Divorce Certificate” shall be issued immediately providing that the certificates of the parties concerned are effective and complete and the agreements comply with relevant provisions upon examination. Otherwise, the registration shall not be accepted and relevant reason shall be notified to the parties concerned in written form.

VIII. Charges

The expenses fee of divorce registration for each couple is RMB10.

2. the “Divorce Agreement” shall be written in Chinese;

3. the Marriage Registration Center of Shanghai Civil Affairs Bureau provides free service for residents who want to change the marital information on their social security cards.
